Massachusetts staffing firm to pay $95,000 in wage settlement in Shield Packaging case; buyer settled earlier for $1 million

Southern Mass Staffing Inc., of Worcester, Mass., and owner Mesa Som agreed to pay $95,000 to settle wage hour violations for its role in providing workers to staffing buyer Shield Packaging Inc., the Massachusetts Attorney General’s Office announced. Shield Packaging operates a factory in Dudley, Mass., and previously agreed to pay $1 million. The staffing firm’s settlement is in addition to what Shield Packaging paid over hindering an investigation and wage and hour violations, according to the Attorney General’s Office.

Shields Packaging’s settlement affected 480 workers. The company sells custom aerosol packaging products and workers primarily fill, label and package aerosol containers on assembly lines.

Southern Mass Staffing, also known as SMS, provided between 50 and 100 temporary workers each day to Shield Packaging. The Attorney General’s Office reported that it found Shield was a joint employer and used SMS in an attempt to escape liability for wage and hour violations.

The Attorney General’s Office reported its investigation found that SMS failed to pay minimum wage and provide earned sick time, suitable paystubs and temporary worker notices to hundreds of workers between April 2015 and October 2016. More than 270 workers will receive restitution for earned sick time not made available to them by SMS.

Shield Packaging was also hit with $150,000 in a separate case last year when a staffing agency worker was injected with a flammable propellant gas, the US Occupational Safety and Health Administration reported.
