UK – Recruitment sales manager could receive £1 million after boss’s punch left him brain damaged (BBC)

A sales manager who suffered catastrophic brain damage from a punch by his boss will receive damages in an appeal court ruling, reports BBC News. The sales manager, 62-year-old Clive Bellman was hit by his boss, John Major, managing director of Northampton Recruitment Ltd at the time, during a "heated and work-related discussion" in Northampton, in December 2011 and was left with a fractured skull and has a metal plate installed in his head. Senior judges at the Court of Appeal ruled Northampton Recruitment Ltd was "vicariously liable" for the actions of John Major. Bellman’s lawyer claimed Bellman could receive over £1 million in a damages payout. Bellman had unsuccessfully sued the company in 2016, however at the Appeal Court last week, Lady Justice Asplin said Major had been "wearing his hat" as the company's managing director when he assaulted Bellman. Asplin said, “It seems to me that Northampton Recruitment's employees who took part in the drinking session can have been in no doubt at that stage that Mr Major was purporting to exercise managerial control over them."
