UK – Ruling on Uber driver’s ‘worker’ status due today

The Court of Appeal is due to deliver its’ judgment in the appeal against a ruling that Uber drivers are workers rather than self-employed independent contractors later today, reports ITV News.

In October, the Court heard Uber’s appeal against the decision of an Employment Appeal Tribunal not to overturn a tribunal ruling that two ‘test’ claimants, who brought claims on behalf of the 40,000 drivers estimated to be operating in the UK, were ‘workers’. The claims, which succeeded, were to establish the drivers’ entitlement to be paid at least the minimum national ‘living wage’ of £7.20; to receive payment for holidays; and to be protected against detrimental action for ‘whistleblowing’.

Fiona Coombe, Director of Legal and Regulatory Research, SIA said “This judgment will be significant for Uber’s operation in the UK, and may have ramifications for their operations in other countries where employment status depends on issues of control”.
