Netherlands – Trade union FNV takes Randstad and PostNL to court

FNV, the Netherlands Trade Union Confederation, is taking staffing giant Randstad and mail company PostNL to court.

According to AD.nl, FNV is demanding that employees who work on a temporary basis at PostNL sorting centers are paid the same as permanent employees who do the same work. Employees who have missed out on wages must also receive supplementary payment, according to the union.

Randstad issued a response to the union's allegations.

In February 2019, FNV accused Randstad subsidiary Tempo Team of evading Collective Labour Agreement rules for workers at PostNL. The union said that thousands of parcel sorters who work the night shift at nine locations should be entitled to wage compensation for their work at PostNL with damages potentially amounting to €8 million.

Last week, FNV won a similar lawsuit against PostNL and employment agency InPerson. The judge had ruled that temporary workers are entitled to equal pay for equal work.

PostNL has previously said that the company operates fully within the law with regards to contracting.

Randstad supplies temporary workers to 10 PostNL package depots, including in Leeuwarden, Utrecht, Nieuwegein, Breda, Son, Den Bosch and Opmeer.
