Temps injured in Wisconsin can now sue instead of claim workers’ comp (The National Law Review)

Staffing buyers in Wisconsin are subject to lawsuits from temporary workers who suffer injuries, even if the employer has workers’ comp, according to an article in The National Law Review that was written by Eric Hobbs of Ogletree, Deakins, Nash, Smoak and Steward PC. A Court of Appeals in Wisconsin found that temporary workers can claim workers’ comp or file a lawsuit in the event of injury. “The court’s decision ironically grants to temporary workers who work alongside regular employees a greater right, in the event they are injured as a result of work, than the regular employees have,” according to the article.
