Pomeroy deal draws second lawsuit

Pomeroy IT Solutions Inc. (NASD: PMRY) said a second stockholder lawsuit was filed to prevent the company from being acquired by founder David Pomeroy II, according to a filing with the U.S. Securities and Exchange Commission.

The new lawsuit was filed May 29 in Delaware court by shareholder Michael Hughes as a class action suit, according to the filing. The first lawsuit was filed by Kenneth Hanninen in Kentucky court.

The Hebron KY-based information technology services and staffing firm said it believes the suits are without merit and will defend itself, according to SEC filings.

Pomeroy announced in May the deal to be acquired by its founder for $5.02 a share, for each share not already owned by Pomeroy or his wife. The deal was expected to close in the third quarter.
