Ontario bakery fined C$70,000 in temp worker injury case

October 17, 2017

The Ontario Ministry of Labour on Friday fined a commercial food manufacturing company C$70,000 (US$55,960) for an incident in Concord that injured a temporary worker.

FGF Brands Inc., which produces baked goods, pleaded guilty to failing as an employer to ensure that the measures and procedures in section 76 of the Ontario Regulation 851/90 — the Industrial Establishments Regulation — were carried out in the workplace.

According to the Ministry, a temporary worker in July 2016 was trapped and injured by a dough machine that had been started up while cleaning was being done. The worker was trapped until the equipment could be dismantled. The worker suffered critical injuries and was transported to hospital.

Justice of the Peace Karen Walker handed down the sentence in the Ontario Court of Justice. The court also imposed a 25% victim fine surcharge, which is credited to a special provincial government fund to assist victims of crime.
