A federal grand jury indicted the owner of a Kansas medical staffing firm with seven counts of willful failure to pay over employment taxes to the Internal Revenue Service, the US Department of Justice announced in a criminal indictment filed on Wednesday.
The indictment alleges David Monhollon owned First Call Medical Group. From 2011 through 2013, First Call withheld payroll taxes from its employees’ paychecks; however, for seven of the nine calendar year quarters, First Call did not fully pay over the payroll taxes to the IRS.
If convicted, Monhollon faces a statutory maximum sentence of five years in prison for each count. He also faces a period of supervised release, restitution, and monetary penalties.
