Distribution coming for $46.5 million in Instacart IC misclassification settlement

Funds from a $46.5 million settlement in an independent contractor misclassification lawsuit against Instacart are ready to be distributed, San Diego City Attorney Mara Elliott announced.

The city attorney filed a lawsuit against Instacart four years ago and the settlement was reached in October 2022, though the final judgment was entered by the court only recently.

Instacart had denied wrongdoing in the settlement.

Receiving money from the settlement will be approximately 308,000 people who worked for Instacart in California between Sept. 13, 2015, and Dec. 15, 2020 — the time period covered by the settlement. Reimbursement amounts will vary by worker.

The terms of the final judgment also provide for up to $6 million in civil penalties to paid to the city attorney’s Consumer Protection Prosecution Trust Fund.
