Beware of ‘no-poaching’ deals in recruiting (Staffing Industry Review)

Agreements among competitors not to hire one another’s employees — or limit wages and benefits — can run afoul of the law, Dan Forman writes in the July/August 2018 issue of Staffing Industry Review magazine. “A failure to comply with all antitrust laws, including the bar on anti-poaching, will more likely invoke the significant disruption, costs and scrutiny of civil and criminal prosecution,” writes Foreman, who is a managing partner with employment law firm Carothers DiSante & Freudenberger LLP.
