Appeals court to rehear Uber argument in fight over AB 5 (Courthouse News Service)

The 9th Circuit Court of Appeals will rehear an argument by Uber that it was unfairly singled out by California law AB 5, which aimed to classify gig economy workers as employees, Courthouse News Service reported. A three-judge panel of the court already agreed that Uber had a plausible argument, but Uber’s case will now be heard by a full 11-judge panel, the news agency reported. AB 5 was passed in 2019 to get tough on independent contractor misclassification; however, Proposition 22 approved by California voters in 2020 allowed Uber and Lyft to continue classifying drivers as independent contractors. The case over AB 5 remains important as Proposition 22 is under attack in a separate lawsuit.
