Concerns over H-1B visa holders' legal status

More than a quarter million legal immigrants may lose status and have to leave the US by the end of June, according to a report by Jeremy Neufeld, immigration policy analyst at the Niskanen Center.

“The Covid-19 pandemic is spreading and will — it likely has already — put the economy into recession. Our immigration system is poorly designed for immigrants to weather this kind of crisis,” Neufeld wrote. Unless the administration and Congress make policy changes, the workers will lose status and be required to leave the country.

H-1B visas are not impacted at this time by the president’s order curtailing immigration, Quartz reported. However, concerns remain.

The visas allow workers to stay in the US for six years, during which time their employers can petition for employment-based immigrant visas. But the wait for that visa can take decades for immigrants from some countries and maintaining their H-1B status can be difficult in the meantime.

Some immigrants are in a difficult situation with businesses having closed during the Covid-19 crisis, according to an article by Bloomberg.
