UK – Temporary worker has contract terminated after breaking leg (The Guardian)

02 November 2018

A temporary agency worker who worked with the Automobile Association (AA) via Guidant Global has had his contract terminated after he broke a leg while on his way to work, The Guardian reports.  Alex Wright, whose contract was ended with immediate effect less than a week after he found himself in hospital, had no accident cover. His assignment was due to end on 31 December 2018. Wright faces at least a month without work while he recuperates with his leg in a cast. He will also be on benefits and has no sick pay or redundancy pay to fall back on. Wright said his contract suggested he could receive sick pay after four days but he never got to claim it as his contract was ended. Guidant Global said it was reviewing Wright’s case with the AA but could not confirm any details until that process was complete. “Guidant Global is committed to treating all of our workers in a fair and transparent manner,” the company stated. A spokesperson for the AA  said Wright’s case was being dealt with directly by the agency. It added: “We have a very small number of temporary workers and they are covered by the terms and conditions of their agency. However, we are committed to the fair treatment of all of our workers.”

Clarification

Staffing firm response:

A spokesperson for Guidant Global said: “A worker employed by Guidant Global on behalf of the AA has complained that following an accident on the way to work which resulted in him breaking his leg, he has lost employment benefits. He said on social media that he was not entitled to sick pay, but this is not true. We have now been in touch with him as we believe that he misunderstood his entitlement to Statutory Sick Pay. We have confirmed in writing that he is, of course, entitled to 28 weeks sick pay and he has in fact already claimed this for his first week. We’re sorry that this was not clear from the beginning.”
