UK – Recruitment firm admits to misleading Pensions Regulator and avoiding auto-enrolment duties (Professional Pensions)

Hertfordshire-based SKL Professional Recruitment Agency and its managing director have pleaded guilty to misleading The Pensions Regulator by falsely claiming staff had been put into a workplace pension, reports Professional Pensions. In August 2019 it was reported that SKL and managing director Linus Kadzere were set to be prosecuted by the Regulator on suspicion of trying to avoid providing staff with a workplace pension. In a false declaration of compliance, Kadzere told the Regulator that his company had automatically enrolled 22 staff. However, following an investigation by the Regulator, it emerged that although a pension scheme had been set up, staff were not enrolled and contributions deducted from salaries had not been paid into the scheme. TPR director of auto-enrolment Darren Ryder, commented, “"Staff who are eligible for automatic enrolment trust their employer to do the right thing so they are given the opportunity to save. The Pensions Regulator will not stand by if an employer does not meet their responsibilities and we will take action to make sure workers get the pensions they are entitled to.” Both Kadzere and SKL Recruitment will be sentenced on 17 December 2019 at Brighton Magistrates' Court.
