UK – London bicycle courier wins gig economy employment rights case

09 January 2017

A London-based bicycle courier has won the right to be classed as an employee rather than self-employed, which entitles her to employee rights such as holiday pay and minimum wage, reports BBC.

A central London employment tribunal ruled that courier, CitySprint, had wrongly classified bicycle courier Maggie Dewhurst as a self-employed worker. The ruling follows a similar case in which a couple of Uber drivers in London filed a lawsuit over employment rights and won the landmark case.

The ruling could similarly have an effect on the gig economy and could lead to more CitySprint workers coming forward to take action.

Recently, the HMRC has launched a crackdown on companies that deny worker rights to self-employed workers. The crackdown could also have an impact on the gig economy.

Meanwhile, CitySprint has said that it is disappointed with the ruling. The company said in a statement:

"This case has demonstrated that there is still widespread confusion regarding this area of law, which is why we are calling on the government to provide better support and help for businesses across the UK who could be similarly affected.”
