Turkey — Law on temporary employment receives approval

A new draft law regarding the temporary employment relationship and private employment agencies received approval, according to an article by the Erdem and Erdem Law Office.

Up to now, temporary employment relationships had no basis in law in Turkey and the new Draft Law provides a definition and scope of these relationships for the first time. The main goal of the Draft Law will be to allow private employment agencies to act as intermediaries and to improve the flexibility and employability of the workforce.

The Draft Law does set limits on when temporary employment relations can be established such as maternity replacement, seasonality, periodic ‘non-core’ employment and significant increase in workload. Temporary staffing is also banned in workplaces undergoing redundancy, state institutions and underground mining.

The new law does make reference to the EU Agency Workers Directive and, although Turkey is not obliged to observe this Directive, it has established the same principle that temporary workers should receive the same pay as an equivalent permanent worker.
