Spain – Court rules temporary worker is entitled to severance pay

A court in Madrid has ruled that a temporary worker who was fired without any severance pay must be compensated in the same way that a permanent worker would be, reports Bloomberg.

Recently, the EU Court of Justice of the European Union ruled that temporary workers are entitled to the same severance pay as permanent workers. The court said making a distinction between workers by contract type is a form of discrimination.

The temporary substitute worker was fired from the Ministry of Defence in 2012 without any compensation. She then sued her employer after being denied severance pay due to her status as a temporary contract worker. She is now entitled to €6,000 in compensation. According to Bloomberg, this single ruling could possibly bolster the case for Spain to have a single type of labour contract and set a legal precedent for temporary workers in Spain.
