Ireland – Microsoft plans $425 million charge after investigation of LinkedIn

05 June 2023

Microsoft Corp. received notice of a proposed fine following an investigation of LinkedIn by the Irish Data Protection Commission. The software giant also reported it plans to take a charge of approximately $425 million in the fourth quarter of its fiscal year related to the commission’s probe.

LinkedIn ranks as the second-largest online job advertising firm globally, according to SIA research.

The investigation was prompted by a complaint and looked into whether LinkedIn’s targeted advertising practices violated the European Union General Data Protection Regulation, according to Microsoft. Other firms were subject to the investigation as well.

Microsoft reported it received the notice of the fine in April, when the Irish authority issued it in a nonpublic preliminary draft decision.

Microsoft said it had cooperated throughout the probe and will respond to the decision.

“The company intends to dispute the legal basis for, and the amount of, the proposed fine and will continue to defend its compliance with GDPR,” the company said in a statement. “There is no set timeline as to when the IDPC will issue a final decision. However, after receiving a final decision, Microsoft will consider all legal options and intends to defend itself vigorously in this matter.”
