French employers obliged to report refusals to accept permanent work offers on new platform

The Labour Market Law No. 2022-1598, known as the “Full Employment Law” passed on 21 December 2022, introduced obligations for employers to inform the Unemployment Agency, 'Pôle emploi', recently rebranded as France Travail, of the refusal by an employee of the offer of an open-ended contract after the expiry of their fixed-term contract.

Employers have the same duty as it applies to temporary employees who, on two occasions during the previous 12 months, have refused an offer of an open-ended contract from the user company at the end of an assignment. The offers of work must have been given to the employee in writing and be to take up the same or a similar job without changing the place of work.

Employers must inform France Travail electronically on the platform created for this purpose. Such a refusal is likely, under certain conditions, to deprive the employee concerned of receiving unemployment benefit.

As the information platform did not become operational until 10 January 2024, the Ministry of Labour has clarified that the obligation is to be applied retrospectively to any refusals since 1 January 2024. Employers must inform France Travail within one month.
