Nebraska senate passes bill classifying gig workers as independent contractors

Nebraska senators passed a bill March 10 that codifies rideshare and certain delivery drivers as independent contractors in state law. It now goes to the governor for a signature.
LB229 adds workers who use technical applications for marketplace network platforms — such as Uber, Lyft and DoorDash — to an existing list of workers who are classified as independent contractors and excluded from the state’s Employment Security Law.
The legislation was first introduced by Syracuse Sen. Bob Hallstrom on Jan. 14.
After two hours of debate over two days, Hallstrom offered a motion to invoke cloture, which ends debate and forces a vote on the bill and any pending amendments. The motion was adopted on a 33-15 vote, the minimum number required. Lawmakers then voted 33-15 to pass the bill.
The Hill reported Nebraska state Sen. John Cavanaugh slammed the measure in a report from the Omaha World-Herald, saying it “shifts the balance of power from currently more balanced — although still in favor of these corporations — but shifts it more in the favor of the corporations and [against] these workers.”
