Attorneys ask court to appoint receiver for Essential StaffCARE parent

Attorneys representing salespeople in lawsuits against Insurance Applications Group — the parent company of Essential StaffCare — filed motions asking the court to assign a receiver, according to court records. The motions cite questions about the company’s ability to continue as a going concern.
Essential StaffCare provides Affordable Care Act-compliant health insurance and employee benefits to the staffing industry.
Four salespeople filed separate lawsuits during the past year in South Carolina’s Greenville County 13th Judicial Circuit. They cited nonpayment of commissions.
According to filings requesting the assignment of a receiver, IAG has not paid commissions owed to the salespeople. Attorneys cite concerns about its ability to pay.
“Since this case was filed, it has become increasingly apparent that IAG cannot or will not meet its obligations to creditors and employees, and there is reason to believe its assets are being used and encumbered by its owner, defendant Jasper Marshall Dye, III,” according to a court filing from Dec. 5, 2024, by attorney Jeffrey P. Dunlaevy, who represents plaintiffs in two lawsuits.
“It appears that IAG’s assets are being pledged to cover Dye’s personal debts. Dye has been absent from IAG’s place of business for weeks without explanation,” according to the filing. “Moreover, on November 28, 2024, IAG failed to meet a regularly scheduled payroll, leaving all company employees without income entering the holidays and depriving them of wages already earned. Consequently, IAG is or soon will be unable to function as a going concern.”
Without a receiver, there is significant risk that “corporate records may be compromised, causing irreparable damage to Plaintiff and other IAG employees,” according to the filing.
The lawsuits name IAG, Dye and Marisa Mazur, IAG’s VP of finance, as defendants.
The defendants’ attorneys, S. Sterling Laney III and Jason D. Wyman, have not returned requests for comment. Attorneys for the plaintiffs have also not yet returned requests for additional comment.
