Temporary workers generally prefer virtual interviews. In particular, 43% indicated a strong preference for them, while 25% strongly preferred in-person. Convenience, avoiding illness and feeling less anxious were among the arguments for virtual interviewing, while those who sought to interview in person cited stronger interpersonal connections and avoiding tech glitches for their predilection.

The Right to Control

When a statute does not adequately define “employee” - as opposed to independent contractor - the hiring party must interpret the term by reference to the common law of agency, per the US Supreme Court. The central question to be answered under the common law test is whether the hiring party retains the right to control the manner and means by which the work is to be accomplished. When the hiring party does retain that right, the worker is considered an employee - even if the right is never exercised.
