For businesses, hiring or employing remote talent to perform work from a location other than their worksite or office premises raises various risks and challenges depending on whether the individual is a direct employee, agency worker or independent contractor
Compliance issues include remote / teleworking laws, tax and social security, health and safety, data privacy and immigration. Posted agency workers pose specific risks relating to equal treatment laws, tax and social security, licensing and registration requirements. Independent contractors engaged remotely via platforms or directly are also not without risk. Penalties for misclassification can be severe.
