US – Court Upholds Verdict Against Staffing Firm

An appeals court upheld a jury verdict against Texas-based staffing firm Service Temps Inc., which does business as Smith Personnel Solutions, in a disability discrimination lawsuit, the U.S. Equal Employment Opportunity Commission reported.

The staffing firm allegedly refused to hire Jacquelyn Moncada for a store clerk position because she was deaf despite Moncada’s years of experience as a stock clerk, according to the EEOC.

A Dallas jury ruled against Service Temps on Sept. 22, 2010, but the company appealed the decision to the U.S. Court of Appeals for the Fifth Circuit. The appeals court issued its ruling on April 26 and affirmed the original verdict.

The lower court had awarded $103,200 plus interest in damages for lost wages, emotional harm and punitive damages to Moncada on Jan. 11, 2011.
