The use of background checks can help protect an employer against liability for negligent hiring, supervision or retention. However, background check policies, practices and procedures may also expose an employer to liability. This report explores the current status of U.S. law regarding negligent hiring and supervision, background checks, and liability based upon disparate impact on particular groups and the Equal Employment Opportunity Commission’s interest in heightened enforcement in this area.
