Report: Majority of Port Truckers Are Misclassified

A new report says 50,000 of the 75,000 truck drivers at major U.S. ports are misclassified as independent contractors. And it says port drivers are fighting back.

The National Employment Law Project produced the report along with Change for All and a group called Los Angeles Alliance for a New Economy. The report focuses on the negative impact of classifying workers incorrectly as independent contractors.

In California, some 400 port drivers have filed labor law complaints with the California Division of Labor Standards Enforcement, and DLSE hearing officers have issued at least 19 decisions that drivers are employees.

The report cited several cases against trucking companies, including a case in California where five drivers were awarded $537,527.
