US – Staffing Firm Settles With Feds for $100,000

A healthcare staffing firm will pay $100,000 to settle allegations it posted discriminatory job ads that limited positions to U.S. citizens, the U.S. Attorney’s Office announced today. Onward Healthcare, based in Wilton, Conn., also agreed to change its internal policies and to be subject to reporting and compliance monitoring requirements for three years.

“Onward Healthcare has amicably resolved an independent investigation brought by the OSC-DOJ against the company,” according to a statement issue by Steven Dobrowski, director of marketing and communications at Onward Healthcare. “The substance of the investigation centered around company-sponsored job postings which contained language that the DOJ concluded was objectionable. While not admitting fault in the matter, Onward agreed to resolve the investigation to avoid the uncertainty of litigation. Onward has and continues to treat all individuals equally regardless of citizenship, immigration status or national origin.”

The company’s ads were on its home page and third-party websites, according to the U.S. Attorney’s Office.

“Federal law protects people who are authorized to work in the United States from facing discriminatory barriers when they are seeking employment,” said Thomas Perez, assistant attorney general for the Civil Rights Division. “Employers should ensure that their online job postings to no violate the anti-discrimination provision of the Immigration and Nationality Act.”
