US – H-1B visas to be distributed via lottery

April 08, 2013

Staffing users may not get the H-1B visas they want this year as more petitions for H-1B visas have been received than are slots available. As a result, the available H-1B slots will be distributed by lottery.

U.S. Citizenship and Immigration Services announced Friday it is no longer accepting H-1B visa petitions, as the number of petitions received already reached the cap of 65,000 for the upcoming federal fiscal year. The agency also reached the cap for 20,000 further H-1B petitions under the advanced degree exemption.

The agency had earlier announced it anticipated reaching the cap and using a lottery system for the first time since 2008 to allocate H-1B visas.
