Group of internal workers sue Randstad for overtime pay

Four employees of Randstad Staffing in Michigan filed a complaint in U.S. District Court alleging Randstad misclassified workers to avoid paying overtime.

The complaint alleges Randstad would classify employees as managers, supervisors or executives, then require them to work in excess of 50 to 60 hours a week. With such classifications, under federal labor laws, such employees are not due overtime compensation. The plaintiffs seek to recover overtime based on a time-and-a-half calculation earned, beginning three years before the commencement of the lawsuit.

“The complaint is that they were misclassified and they were not paid overtime wages, and that there should have been time-and-a-half overtime wages under the Fair Labor Standards Act,” said Attorney Jennifer McManus of law firm Dib & Fagan, P.C., which is working with Florida law firm Kelley/Uustal on the lawsuit.

The complaint, filed in U.S. District Court for the Eastern District of Michigan Southern Division, seeks to be recognized as a class action.

“Randstad does not comment on pending litigation and instead handles legal matters pursuant to established court procedures,” Randstad said in a statement. “Randstad adamantly denies plaintiffs' allegations of alleged wage & hour violations and will vigorously defend its legal interests in court.”

According to the filing, four plaintiffs worked at Randstad’s Troy, Mich., facility.

  • Judith Perry became an employee of Randstad in February 2012 and worked as a staffing consultant and a senior staffing consultant.
  • Erin Lane became an employee of Randstad in January 2012 and worked as a talent acquisition specialist, account manager, and senior account manager for Randstad.
  • Suhaima Choudhury became an employee of Randstad in April 2012 and worked as a talent acquisition specialist.
  • Aimee Dooling became an employee of Randstad in December 2011 and worked as a staffing consultant, account manager and senior account manager.
