Court Rules California Recruiters Are Exempt

March 27, 2012

A group of recruiters in California was found exempt from wage and hour laws by the California Court of Appeal, according to the March 2012 issue of the Legs & Regs Advisor. The recruiters claimed staffing firm Surrex didn’t pay them overtime and meal period compensation. However, the court ruled the recruiters were not owed overtime under California law as they were subject to the commissioned employee exemption.
