Court OKs preliminary max settlement of $8.8 million in Manpower case

A federal judge in California approved a maximum $8.75 million preliminary settlement in a class action case involving 20,270 Manpower temporary employees in California, according to court records.

The lawsuit claimed Manpower didn’t timely pay workers in California because paychecks were mailed from Texas and not received until two or three days later.

“Defendants’ failure to pay timely wages was intentional and willful because they mailed all paychecks to California employees from Texas on the payday following the week in which they worked. Therefore, Defendants knew or should have known that Class Members, all of whom are or were California employees, would not receive their paychecks for at least two to three days after the payday of the following calendar week," stated court documents.

It also claims the statements didn’t include dates for which the employee was paid or name and address of legal employer as required by law, according to the lawsuit. It also claims failure to pay timely wages due at separation.

Named plaintiff is Vera Willner, who was employed by Manpower in Los Angeles from November 2009 until Jan. 26, 2011.

The case number is 3:11-cv-02846-JST
