Reuters reports the California Employment Development Department determined that a former Uber driver in Southern California was an employee, not an independent contractor as the company has claimed. It’s the third such ruling that an Uber driver is an independent contractor, according to the report.

In a separate instance earlier this month, a US District Court judge ruled a lawsuit involving Uber drivers claiming they were misclassified as independent contractors can proceed as a class action suit.
